Anne Arundel ranks among the highest counties in the nation for waterfront property. Maryland has more state and local laws relating to land use than most jurisdictions, especially when it comes to land within one thousand feet of most waterways (known as the critical area).

Harry C. Blumenthal has provided legal and administrative representation for more land development and construction projects in Anne Arundel County than any other attorney in the County. His primary area of practice is land use, including zoning, subdivision, development, permitting, and critical area issues before such County agencies as the Office of Planning and Zoning, the Department of Inspections and Permits, and the Department of Public Works. He has handled countless variance, special exception, and re-zoning cases before the Administrative Hearing Officer and the Board of Appeals. He has considerable experience in land use litigation and appeals. Mr. Blumenthal’s clients include local, regional, and national developers, telephone and electric companies, cable television and cellular phone companies, and bus and rail companies with facilities in Anne Arundel County.

Mr. Blumenthal provides effective lobbying services. When a change in the law will assist a client, Mr. Blumenthal drafts legislation and gains support for the legislation with the members of the Anne Arundel County Council. Mr. Blumenthal has shaped much of the County’s land use law and practice.

Mr. Blumenthal has extensive experience in commercial and industrial development. He has assisted clients with every regional commercial mall in the County, most community and neighborhood shopping centers, numerous commercial strip centers, and numerous individual commercial pad sites. He has represented the developers of major industrial parks throughout the County. Mr. Blumenthal also has extensive experience in the creation of residential and mixed use communities.

Mr. Blumenthal’s secondary area of practice is closely related to land use. He handles real estate matters and real estate contracts. As the Anne Arundel County real estate market matures, he guides the development of difficult properties and the redevelopment of improved properties, such as the Laurel Racetrack. Mr. Blumenthal assists in the due diligence required for acquisition, refinancing, and real estate title issues, with an emphasis on value-added development potential.

Finally, Mr. Blumenthal serves as an expert witness in land use and administrative matters. The Circuit Court for Anne Arundel County and the Board of Appeals have recognized him as an expert in land use on numerous occasions.

Fred Delavan’s primary area of practice is land use, including issues relating to zoning, subdivision, land development, and Chesapeake Bay Critical Areas issues. He handles administrative and zoning hearings regarding variances, special exceptions, rezonings, and related matters before Anne Arundel County’s Administrative Hearing Officer and the Board of Appeals and before the City of Annapolis Planning Commission and Board of Appeals. Ms. Powers has more than 30 years of experience as a trial lawyer. She has represented clients in general civil litigation in State courts throughout Maryland and in the Federal courts, including cases involving property disputes (boundaries, easements, licenses, trespass, adverse possession, partition, nuisance, piers, landlord/tenant, trees (cutting and damage claims), stormwater management, eminent domain (condemnation), environmental matters (wetlands, hazardous material spills, filling and grading), contract and business disputes.

Ms. Powers has more than 30 years of experience in administrative law, handling cases before a wide range of administrative agencies. She has represented zoning and permit clients before the Boards of Appeals of Anne Arundel County, Talbot County, Queen Anne’s County, City of Annapolis, Town of Leonardtown, and other jurisdictions. She has handled cases in other matters ranging from the Anne Arundel County Animal Control Commission, Amusement License Commission, Board of License Commissioners, Personnel Board, and tax appeals.

Linda M. Schuett’s primary area of practice is land use. Ms. Schuett served as the County Attorney for Anne Arundel County from 1999 to 2006. In that capacity, she represented the County Executive, the County Council, and all branches of County government. She was the author of a comprehensive revision of the County’s laws relating to zoning, subdivision, and development. She authored or supervised comprehensive revisions of the code provisions relating to the Chesapeake Bay critical area; floodplain, grading, and storm water management; impact fees; permits for the use of County-owned rights-of-way; and solid waste facilities. She also authored a comprehensive revision of the Anne Arundel County Code as a whole.

Ms. Schuett handles zoning, subdivision, development, permitting, and critical area issues before such County agencies as the Office of Planning and Zoning, the Department of Inspections and Permits, and the Department of Public Works. She has handled many variance, special exception, and re-zoning cases before the Administrative Hearing Officer and the Board of Appeals.

Ms. Schuett serves as a lobbyist. While County Attorney, Ms. Schuett assisted in the drafting of State legislation and testified before the General Assembly on proposed State legislation. She regularly drafts legislation and appears before the County Council to assist clients in changing the law.

Ms. Schuett’s secondary area of practice is business litigation, including complex commercial, property, land use, and banking issues. She has litigated a wide range of cases, including cases relating to the Anne Arundel County Charter; land use and property issues; construction disputes; contract disputes; and receiverships. She also handles state and federal appeals. She represented the State of Maryland Deposit Insurance Fund Corporation in its capacity as Receiver for various savings and loan associations for more than 14 years.

Ms. Schuett is the co-author of Maryland Rules Commentary, Paul V. Niemeyer and Linda M. Schuett, The Michie Company, 1984; Second Edition, 1992; Third Edition, 2003; Fourth Edition, 2014; a widely recognized treatise on the rules of civil procedure and trial practice. She is also the author of Advance Court Rules Service for Maryland.

Ms. Schuett was a member of the Standing Committee on Rules of Practice and Procedure of the Court of Appeals for 30 years. She served as the Vice-Chair of the Committee for 15 years. She drafted the rules governing discovery, trials, and judgments in the 1984 comprehensive revision of the Maryland Rules. She participated in all rule changes after that time, including rule changes governing civil proceedings in the circuit courts and the District Court and rule changes relating to evidence, appeals, property actions, receivers and assignees, foreclosure sales, judicial sales, tax sales, arbitration, contempt, injunctions, mandamus, attorney discipline, and alternative dispute resolution. She chaired or was a member of the following subcommittees: Discovery, Receivers and Assignees, Alternative Dispute Resolution, Appellate Rules, Visual and Electronic Evidence, Trial Rules, Management of Litigation, General Provisions, Specific Remedies, Probate and Fiduciaries, Professionalism, Form Interrogatories, and Style.

Finally, Ms. Schuett serves as an expert witness on issues relating to trial practice, civil procedure, and ethics. Specifically, she has served as an expert witness on the standard of care with respect to foreclosure and collection of judgment issues, civil procedure issues, discovery matters, receivership issues, and withdrawing from representation of a client. She has testified on the reasonableness of attorney’s fees in a bankruptcy proceeding, on the provisions of Rule 2-652 (enforcement of attorney’s liens), and on the circumstances under which the statute of limitations is tolled in Maryland after a case has been dismissed in another state.

Land Use:

Ms. Schuett handles all zoning, subdivision, development, permitting, and critical area issues. She has also handled many variance, special exception, and re-zoning cases. Representative clients include:

  • Conifer LLC, a real estate company specializing in the development and management of affordable housing communities in New York, New Jersey, Maryland, and Pennsylvania, in obtaining County Council approvals for a project known as Marley Meadows Apartments in Glen Burnie
  • Enterprise Homes, a developer of green, mixed-income communities throughout the mid-Atlantic region, in obtaining a special exception to construct a project known as the Greens at Hammonds Lane Apartments Senior Housing, located in Brooklyn Park
  • Magothy Associates, LLC, in obtaining before the County Council a re-zoning of its properties from residential to commercial, in filing suit to quiet title on paper roads, and in obtaining approvals through the Office of Planning and Zoning to construct a retail shopping center in Pasadena
  • PIRHL, a developer of affordable single-family and multifamily homes, in obtaining County Council approvals, negotiating complex purchase and easement issues with adjoining landowners, and in obtaining approvals from the Office of Planning and Zoning to construct affordable rent-to-own single family dwellings
  • Severn School, Anne Arundel County’s oldest independent school, in obtaining variances and approvals to rebuild the Teel Academic Center and make improvements to its athletic fields
  • Southern Land Company, a national developer of commercial sites and residential communities, in obtaining the removal of a plat note that restricted development of its residential community and in the negotiation of an access agreement with an adjoining property owner
  • StonebridgeCarras, LLC, a real estate investment and development firm for high quality mixed-use projects, in obtaining approvals for its mixed use project in Odenton

In addition, at the request of a County Councilmember, Ms. Schuett chaired a committee to draft a proposed bill to allow workforce housing in Anne Arundel County. The bill became effective in 2011.

Litigation:

Ms. Schuett has practiced in state and federal courts at both the trial and appellate levels. Samples of significant recent reported appellate opinions include:

  • Jones v. Anne Arundel County, 432 Md. 386, 69 A.3d 426 (2013), representing a member of the Anne Arundel County Council on the propriety of his removal from office, with the highest appellate court holding that the removal was improper
  • Lindsay v. Annapolis Rds. Prop. Owners Ass’n, 431 Md. 274, 64 A.3d 916 (2013), representing the owner of a waterfront property against the claims of the homeowner’s association and a neighbor that they owned or had an easement over the entirety of the homeowner’s driveway, with the trial court, intermediate appellate court, and highest appellate court holding in favor of the waterfront homeowner
